In Spain there is no hard-and-fast formula for calculating child support payments. In determining the pensión alimenticia judges take into account the non-custodial parent’s income as well as the child’s expenses (schooling, clothing, meals, etc). Other factors, such as dependents from a previous relationship, may need to be taken into account as well.

Reactions to Aragon Shared Custody Law

Pere Ríos, a Barcelona-based journalist, makes a number of points in favor of shared custody in “Esto es la igualdad”. One is that the new Aragón law will challenge the status quo in Spain by encouraging men as well as women to become caretakers, thus ultimately helping to end workplace discrimination against women.

Aragón Votes in Favor of Shared Custody

Last December I wrote about an initiative underway in Aragón to modify Spain’s 2005 Divorce law in favor of shared custody.  According to an article in today’s El País, Aragón voted this afternoon to make shared custody the prefered option whenever separating or divorcing couples cannot agree on how they will care for their children.

Bikers Around Spain to Rally in Support of Shared Custody on June 13th

Attention bikers and non-bikers alike! On 13 June 2010 the first gathering of motorcyclists in support of shared custody will take place in various cities around Spain. Sevilla, Tarragona, Valencia, Oviedo, Madrid and Las Palmas are all planning to host events.

Shared Custody: Catalunya Shows Flexibility

The Comunidad de Catalunya apparently feels that conflict between parents does not necessarily rule out shared custody. Recently, their Tribunal Superior de Justicia (TSJC) ordered a pair of warring ex-spouses to share the care of their two young children.

David Flores Not Guilty of “Abandono de Familia”

A few weeks ago I wrote about Rocío Carrasco & David Flores’ latest legal battle, in which Carrasco accused Flores of “abandono de familia” for not paying child support as stipulated in a court order.

As it turned out, Flores was found not guilty because his children are with him 50% of the time so he is obviously contributing to their care. Nevertheless, the judge in the case reminded Flores of his obligation to pay child support ; his shared custody arrangement with his ex does not absolve him of this responsibility. In other words, Flores was found not guilty of the penal accusation but he can still be sued under civil law for not paying child support. Which is exactly what Carrasco will probably now do.


An Unusual Arrangement

She moves to a new apartment with her son but can’t stand the idea of the typical custody arrangement: “I didn’t want to have an entire weekend away from Zack twice a month” writes Stacy Morrison in The Ex-Husband Who Never Left. So, she makes a different kind of arrangement, one in which her ex, Chris, keeps a key to her apartment and comes over to be with his son a couple of evenings a week.

Raquel Toledo, the mother from Tenerife currently in jail in Houston, Texas, will be released in a week according to an article in La Opinion. Toledo is in prison for allegedly refusing to allow her ex-husband to see her daughter on several occasions.

Another Spanish Mother Imprisoned Over Custody Dispute

In a story that brings to mind the saga of Maria Jose Carrascosa, a second Spanish woman is now in jail over a custody dispute with her American ex-husband. Raquel Toledo is serving a 90-day sentence in a Houston jail for allegedly violating her shared custody agreement with her ex, Robert Krastchmer. According to the article,“Encarcelada una española en EEUU por impedir la custodia compartida de su hija,” Krastchmer has accused Toledo of not letting him see his daughter on five occasions between 2008 & 2009. The couple met in 2004 but separated after having a daughter.

I recently met a separated father who told me he often misses being with his son. So I assumed he only saw the seven-year-old every other weekend.  To my surprise the father said that he sees his son every day.
